• <br /> 16. Circumstances which have changed since the adoption of Everett's comprehensive plan <br /> which support the proposed land use map amendment include the adoption of the <br /> Snohomish County comprehensive plan, which designated the study area for a density of <br /> 4 to 6 dwellings per gross acre, and the recent Eastmont annexation proposal, which <br /> resulted in substantial additional public input concerning land uses in the study area; and <br /> WHEREAS,the City Council concludes that the above proposed amendments to the Land Use <br /> Map of the Comprehensive Plan satisfy the evaluation criteria for amending the Land Use Map <br /> as required by Section 1. H of Ordinance No. 2161-96. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. The land use designation of the Land Use Map of the Everett Comprehensive Plan for <br /> the Waits Motel property, located on the southeast corner of 13th Street and Lombard Avenue, as <br /> depicted on the attached"Exhibit A, Map #1" as adopted by Ordinance#2021-94, is hereby <br /> amended from 4.4 "Mixed Use Commercial - Multiple Family"to 1.3 "Single Family <br /> Detached, 10 to 12 Dwellings per Gross Acre." <br /> Section 2. The land use designation of the Land Use Map of the Everett Comprehensive Plan for <br /> the Greenspace, Inc. property located at 9707 and 9709 19th Avenue SE, as depicted on the <br /> attached "Exhibit A, Map #2" as adopted by Ordinance#2021-94, is hereby amended from 1.4 <br /> "Single Family Attached, 12 to 15 Dwellings per Gross Acre,"to 4.2 "Community Business." <br /> Section 3. The land use designation of the Land Use Map of the Everett Comprehensive Plan for <br /> the George Kaneris property located at 2225 116th Avenue SE, as depicted on the attached <br /> "Exhibit A, Map#3" as adopted by Ordinance #2021-94, is hereby amended from 1.4 "Single <br /> Family Detached, 5 to 10 Dwellings per Gross Acre,"to 4.1 "Neighborhood Business." <br /> Section 4. The boundaries of Hannabrook Park, J.J. Hill Park, Johnston-Kelly Park, Judd and <br /> Black Park, Howarth Park, Rotary Park, Thornton Sullivan Park, and Henry M. Jackson Park are <br /> hereby amended as depicted on the attached maps attached hereto as Exhibit A, Map#4, 5, 6, 7, <br /> 8, 9, 10, and 11. <br /> Section 5. The Land Use Map designation for Eastmont Area, as depicted on the attached map <br /> attached hereto as Exhibit A, Map #12, is hereby amended from"Single Family Detached, 5 to <br /> 10 Dwellings per Gross Acre"to "Single Family Detached, 3 to 5 Dwellings per Gross Acre." <br /> Section 6. That should any section, subsection, paragraph, sentence clause or phrase set forth in <br /> this ordinance or its application to any person or situation be declared unconstitutional or invalid <br /> for any reason, such decision shall not affect the validity of the remaining portions of this <br /> ordinance or its application to any other person or situation. The City Council of the City of <br /> Everett hereby declares that it would have adopted this ordinance and each section, subsection, <br /> sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, <br /> subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. <br /> Section 7. It is expressly the purpose of this ordinance to provide for and promote the health, <br /> safety and welfare of the general public and not to create or otherwise establish or designate any <br /> particular class or group of persons who will or should be especially protected or benefited by the <br /> terms of this ordinance. <br /> It is the specific intent of this ordinance that no provisions nor any term used in this ordinance is <br /> intended to impose any duty whatsoever upon the City or any of its officers or employees. <br />
