material and issues raised by the public concerning adult use <br /> businesses and recommendations for ordinance revisions to the <br /> City' s adult use regulatory scheme based upon the above; and <br /> 10 . The Planning Commission held a public hearing on the <br /> extension to the interim policies on September 10 , 1996 , and the <br /> City Council also held a public hearing on the extension on <br /> October 16, 1996 ; and <br /> 11 . Since 1986, the City has formally provided for reasonable <br /> alternative locations for adult use businesses through its zoning <br /> regulations and comprehensive plan policies which locations are <br /> primarily in Southwest Everett and certain other commercial and <br /> industrial zones subject to additional locational requirements . <br /> The amendments set forth in Ordinance No. ' s 2143-96 and 2144-96 <br /> along with the findings and conclusions set forth in Resolution <br /> No . 4264 clarified the issues for purposes of responding to Judge <br /> Farris' ruling; and <br /> 12 . The Planning Commission held a public hearing on September <br /> 10 , 1996 , at which time public comment was received both orally <br /> and in writing. The Planning Commission directed that the <br /> written materials be reviewed in conjunction with the work plan; <br /> and <br /> 13 . The written materials which the public provided at the <br /> Planning Commission' s public hearing have been provided to the <br /> City Council; and <br /> 14 . The comprehensive plan text amendment is based upon <br /> consideration of the following: <br /> A. Circumstances which have changed since the adoption of <br /> the comprehensive plan include the decision of Snohomish <br /> County Superior Court Judge Farris related to Everett' s <br /> zoning code regulations and comprehensive plan pertaining to <br /> adult use businesses, which have necessitated the amendment <br /> of the comprehensive plan policies; <br /> B. New information not available at the time the <br /> comprehensive plan was adopted includes the above referenced <br /> court decision, which justifies the addition of land use <br /> policies related to adult use businesses; <br /> C. The proposed addition of land use policies to the <br /> comprehensive plan related to adult use businesses promote a <br /> more desirable growth pattern for the community asa whole <br /> by preserving the regulatory scheme for adult use businesses <br /> the City Council originally adopted in 1986 ; and <br /> D. While the appeal to the Growth Hearings Board alleges <br /> conflicts with other plan policies, the City Council finds <br /> that the alleged inconsistencies will be evaluated and <br /> 2 <br />
