_REIT <br /> ORDINANCE NO. 02/Z6" 96 <br /> AN ORDINANCE amending the moratorium on public places of adult entertainment and <br /> adult use businesses, Ordinance No. 2138-96. by extending the moratorium for an <br /> additional six months. <br /> WHEREAS,the City Council does find: <br /> 1. Since the adoption of the moratorium on public places of adult entertainment <br /> and adult use businesses, Ordinance No. 2138-96, the City's interim zoning <br /> amendments (Ordinance No. 2144-96) and interim comprehensive plan <br /> amendments (Ordinance No. 2143-96) have been challenged before the Growth <br /> Hearings Board. Additionally, challenges to the City's adult use regulatory <br /> scheme exist in both state court and federal court; and . <br /> 2. Said interim zoning and comprehensive plan regulations are intended to protect <br /> and provide safety to certain sensitive land uses from the secondary adverse <br /> impacts of adult use businesses and <br /> 3. The City receives business inquiries concerning existing regulations relating to <br /> sexually oriented adult entertainment businesses and various licensing and permit <br /> applications relating to such businesses; and <br /> 4. Absent the existence of such adult use zoning regulations, the City cannot <br /> regulate these businesses and the secondary adverse impacts of these businesses <br /> through the use of separation requirements; and <br /> 5. These secondary adverse impacts pose a threat to the public health and safety; <br /> and <br /> 6. Until the City obtains a ruling from the Growth Hearings Board concerning the <br /> interim zoning and comprehensive plan amendments which is anticipated <br /> following the expiration of the existing interim regulations, and until such time <br /> as the City is able to make any required changes to comply with the Board's <br /> decision, the City's regulatory scheme is in jeopardy of being compromised <br /> absent the existence of this moratorium; and. <br /> 7. The City Council did hold a public hearing on the moratorium on May 8, 1996, <br /> amended the moratorium by the adoption of Ordinance No. 2145-96 and <br /> adopted findings and conclusions in Resolution No. 4264; and <br /> 1 <br />
