• <br /> 8. The extension to the moratorium provided in this ordinance does not in any way <br /> repeal or modify Ordinance No. 2145-96; and <br /> 9. The City Council did hold a public hearing on September 18, 1996, to consider <br /> extending the moratorium; and. <br /> 10. The moratorium will terminate unless extended by the adoption of this ordinance <br /> amending Ordinance No. 2138-96; and <br /> 11. The challenges to the adult use ordinances have raised a number of technical as <br /> well as legal issues regarding the affects of the ordinances; and <br /> 12. An extension of the moratorium would allow the City to implement a work plan <br /> that would result in a study that includes staff's review of the challenges to the <br /> interim regulations, staff's monitoring of the litigation of the City's adult use <br /> regulatory scheme, staff's evaluation of the material and issues raised by the <br /> public concerning adult use businesses and possible recommendations for <br /> ordinance revisions to the City's adult use regulatory scheme; and <br /> WHEREAS,the City Council does conclude: <br /> The moratorium concerning the licensing and the siting of adult use businesses <br /> must be extended for one additional six(6) month renewal period to act as a <br /> stop-gap measure since the City's interim zoning and comprehensive plan <br /> amendments are being challenged which challenges could adversely effect <br /> the City's regulatory scheme for adult use businesses, to provide the City <br /> with the opportunity to secure additional public input from comments and <br /> the public hearing process, to continue to monitor the challenges to its <br /> regulatory scheme and to make appropriate revisions. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 2 of Ordinance No. 2138-96, as amended by Ordinance No. <br /> 2145-96, which reads as follows: <br /> Moratorium Imposed.. The City Council hereby imposes a moratorium on the <br /> acceptance of any application for or issuance of any City license, permit or approval for <br /> including, but not limited to, State Environmental Policy Act (SEPA), land use application, <br /> business license, specialty license or building permit for the establishment, location or <br /> licensing of public places of adult entertainment or adult use businesses in the City for a <br /> period of six (6) months beginning on the effective date and time of this ordinance. During <br /> this period, City staff shall review the City's zoning regulations for adult use businesses and <br /> licensing regulations for public places of adult entertainment and propose appropriate <br /> ordinance revisions. <br /> be and the same is hereby amended to read as follows: <br /> 2 <br />
