.Moratorium Imposed. The City Council hereby imposes a moratorium on the <br /> acceptance of any application for or issuance of any City license, permit or approval for <br /> including, but not limited to, State Environmental Policy Act (SEPA), land use application, <br /> business license, specialty license or building permit for the establishment, location or <br /> licensing of public places of adult entertainment or adult use businesses in the City for a <br /> period of six (6) months beginning on the effective date and time of this ordinance. <br /> Provided, this initial six (6) month period shall not lapse and this ordinance shall <br /> continuously remain in effect for any one or more six (6) month renewal periods <br /> subsequently adopted. <br /> Section 2: Section 3 of Ordinance No. 2138-96, as amended by Ordinance No. <br /> 2145-96, which reads as follows <br /> Effective Period For a period of six (6) months from the effective date and time of <br /> this ordinance, no City license, permit or approval that is applied for after the effective date <br /> and time of this ordinance shall be accepted or issued for any adult use business, or public <br /> place or adult entertainment facility as defined herein, Within sixty (60) days of the effective <br /> date of this ordinance, the City Council shall hold a public hearing on the adopted <br /> moratorium. <br /> be and the same is hereby amended to read as follows: <br /> Effective Period. For a period of six(6) months from the effective date and time of <br /> this ordinance, unless this period is extended as provided herein, no City license, permit or <br /> approval that is applied for after the effective date and time of this ordinance shall be <br /> accepted or issued for any adult use business, or public place of adult entertainment facility <br /> as defined herein. <br /> Section 3: Ordinance No. 2138-96, as amended by Ordinance No. 2145-96, is <br /> hereby amended by the addition of the following section for the purpose of extending the <br /> moratorium for an additional six(6) month renewal period: <br /> Notwithstanding any language in this ordinance, this ordinance shall not lapse and <br /> shall be extended for an additional six (6) month renewal period. During this period a work <br /> plan shall be implemented which shall result in a study that includes staff's review of the <br /> challenges to the interim regulations for adult use businesses, staff's monitoring of the <br /> litigation of the City's adult use regulatory scheme, staff's evaluation of the material and <br /> issues raised by the public concerning adult use businesses and recommendations for <br /> ordinance revisions based upon the above. <br /> Section 4. Severability. If any section, subsection, sentence, clause, phrase or <br /> word of this ordinance should be held to be invalid or unconstitutional by a court of <br /> competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the <br /> 3 <br />
