.Moratorium Imposed. The City Council hereby imposes a moratorium on the acceptance of any application for or issuance of any City license, permit or approval for including, but not limited to, State Environmental Policy Act (SEPA), land use application, business license, specialty license or building permit for the establishment, location or licensing of public places of adult entertainment or adult use businesses in the City for a period of six (6) months beginning on the effective date and time of this ordinance. Provided, this initial six (6) month period shall not lapse and this ordinance shall continuously remain in effect for any one or more six (6) month renewal periods subsequently adopted. Section 2: Section 3 of Ordinance No. 2138-96, as amended by Ordinance No. 2145-96, which reads as follows Effective Period For a period of six (6) months from the effective date and time of this ordinance, no City license, permit or approval that is applied for after the effective date and time of this ordinance shall be accepted or issued for any adult use business, or public place or adult entertainment facility as defined herein, Within sixty (60) days of the effective date of this ordinance, the City Council shall hold a public hearing on the adopted moratorium. be and the same is hereby amended to read as follows: Effective Period. For a period of six(6) months from the effective date and time of this ordinance, unless this period is extended as provided herein, no City license, permit or approval that is applied for after the effective date and time of this ordinance shall be accepted or issued for any adult use business, or public place of adult entertainment facility as defined herein. Section 3: Ordinance No. 2138-96, as amended by Ordinance No. 2145-96, is hereby amended by the addition of the following section for the purpose of extending the moratorium for an additional six(6) month renewal period: Notwithstanding any language in this ordinance, this ordinance shall not lapse and shall be extended for an additional six (6) month renewal period. During this period a work plan shall be implemented which shall result in a study that includes staff's review of the challenges to the interim regulations for adult use businesses, staff's monitoring of the litigation of the City's adult use regulatory scheme, staff's evaluation of the material and issues raised by the public concerning adult use businesses and recommendations for ordinance revisions based upon the above. Section 4. Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the 3
