• 740,1fETT CITY OF EVERETT ORDINANCE # 2170-942 An Ordinance Amending Ordinance No. 1671-89, Establishing a New"Public Park"Zone in the Zoning Code, Eliminating the "Public Park" Overlay Zone, Rezoning 24 City-owned Parks to the New"Public Park"Zone, and superseding Section 66 of Ordinance No. 1849-92. WHEREAS, the Everett City Council has heard from citizens concerned about the absence of a"public park" zone; and WHEREAS, the City Council wishes to establish a simpler permit process for the development and improvement of current and future City parks than is presently allowed by the zoning of park lands; and WHEREAS, the City Council has directed the Planning and Parks Departments to draft a new Public Park zone to be included in the Everett Zoning Code to accomplish these objectives; and WHEREAS, the Planning Commission did consider the proposed "Public Park" zone and recommends that the City Council approve the new Public Park zone, eliminate the existing Public Park Overlay zone, and that 24 City-owned parks be rezoned to the new Public Park Zone; and WHEREAS, the City Council has conducted a public hearing to consider the recommendations of the Planning Commission and the Park Commission; and WHEREAS,the City Council finds that the establishment of the Public Park zone and rezoning of the 24 City owned park properties described herein: 1. Are consistent with the Land Use Map of the Everett Comprehensive Plan; 2. Bear a substantial relation to the public health, safety and welfare; and 3. Promote the best long-term interests of the Everett community. 4. Promote stewardship that preserves, protects, and enhances public park lands. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1. Section 66 of Ordinance No. 1849-92 is hereby superseded. Section 2. Ordinance No. 1671-89, as amended, is hereby amended by the addition of the following Chapter establishing a"Public Park"zone:
