Recipients are encouraged to consider the need for language services for LEP persons served or encountered both in developing their programs and budgets and in conducting their programs and activities. Reasonable costs associated with providing meaningful access for LEP individuals are considered allowable program costs. 32. EQUAL TREATMENT FOR FAITH BASED ORGANIZATIONS The Contractor agrees to comply with the applicable requirements of 28 CFR, Part 38, the Department of Justice regulation governing"Equal Treatment for Faith Based Organizations' (the"Equal Treatment Regulation"). The Equal Treatment Regulation provides in part that Department of Justice grant awards may not be used to fund any inherently religious activities, such as worship,religious instruction, or proselytization. Recipients of grants may still engage in inherently religious activities,but such activities must be separate in time or place from the Department of Justice funded program, and participation in such activities by individuals receiving services from the Contractor must be voluntary. The Equal Treatment Regulation also makes clear that organizations participating in programs funded by the Department of Justice are not permitted to discriminate in the provision of services on the basis of a beneficiary's religion. 33. POLITICAL ACTIVITIES Political activity of local Contractor employees and officers are limited by the State Public Disclosure Act and the Federal Hatch Act. No funds may be used for working for or against ballot measures or for or against the candidacy of any person for public office. The Contractor shall certify that no funds payable under this Agreement will be paid by or on behalf of the Contractor to pay any person for influencing or attempting to influence an officer or employee of any agency, Member of Congress, an officer or employee of Congress, or any employee of Member of Congress in connection with the awarding of any federal or state Contract, grant, loan, or cooperative agreement. 34. CONFLICT OF INTEREST AND KICKBACKS Employees, subcontractors, and board or committee members shall not use, or give the appearance of using,their positions for the personal gain of themselves or those with whom they have family,business or other ties. Employees, subcontractors and board or committee members shall not have or acquire any interest, direct or indirect,which would conflict with the performance of services under this Agreement. The Contractor shall not employ or subcontract with persons who have conflicts of interest, nor appoint them as members of its governing board or advisory committee. t Page 13 of 18
