EXHIBIT A <br /> Oral Decision <br /> 1 of lots in the southwest Everett area, Lots 22 through 27, <br /> 2 which are owned by Fluke and have their entire <br /> 3 manufacturing complex located thereon. Again these are not <br /> 4 truly potentially available lots. They are not part of the <br /> 5 generic commercial real estate market. <br /> 6 I did not exclude lots owned by Boeing or Fluke <br /> 7 that were not developed. I don't accept the argument that <br /> 8 those might not become available. For the right price, <br /> 9 they might be willing to sell them. But as to those where <br /> 10 huge manufacturing buildings are built, the Court finds <br /> 11 those unavailable. <br /> 12 I will indicate that in many of the lots that I <br /> 13 am finding available, there are warehouses built on those, <br /> 14 as can be seen in the videotape. The mere fact a warehouse <br /> 15 is on the lot I do not find makes it unavailable, where <br /> 16 it's simply a regular warehouse which could be converted <br /> 17 into an adult business use or torn down. I am only finding <br /> 18 this as to a few lots in southwest Everett, because these <br /> 19 are not just normal warehouses, these are extraordinarily <br /> 20 gigantic buildings, and their square footage is contained <br /> 21 on the exhibits. - <br /> 22 After all these findings, what this leaves in <br /> 23 east Everett are the following lots as available, I <br /> 24 believe. 2 , 3 , 4 , 5, 6 , 7 , 8 , 9 , 10, 11, 12 , 13 , 17, 21, <br /> 25 22 , 24 , 25, and 27A.
