Oral Decision <br /> 1 I further make the following findings regarding <br /> 2 those parcels: They are very close to downtown Everett, in <br /> 3 fact, within blocks of Everett and this courthouse. The <br /> 4 area surrounding them contains all kinds of commercial <br /> 5 uses, as indicated in one of the exhibits. The area <br /> 6 surrounding that area is commercially used. This area is <br /> 7 criss-crossed by roads, including freeways, and contains <br /> 8 good access to I-5. I-5 runs right through the middle of <br /> 9 it. While it is true that it is warehouse and light <br /> 10 industrial, I was not able to identify on these remaining <br /> 11 lots anything that made them unsuitable for a generic <br /> 12 commercial enterprise. <br /> 13 Although this leaves 18 parcels in east Everett, <br /> 14 the Everett code provides that there is a setback of 500 <br /> 15 feet between parcels of two adult business uses. A site <br /> 16 study was done in Exhibit 11 by a plaintiff ' s expert. And <br /> 17 based on that, and the sites I have indicated available, <br /> 18 while there are 18 parcels to choose from, the most that <br /> 19 could be sited there, adult business uses at one time, <br /> 20 would be three. That is, when one adult business picked a <br /> 21 site, that would exclude certain other parcels for some <br /> 22 other adult business to use, because they would be touching <br /> 23 that parcel that had been chosen. <br /> 24 In southwest Everett, I find only the following <br /> 25 parcels potentially remain: 3 , 5, 6, 13 , and 20, which is <br /> 36 <br />
