• <br /> • <br /> 1- This ordinance is consistent with the Everett Comprehensive <br /> Plan; <br /> 2- This ordinance bears a substantial relationship to the public <br /> health, safety and welfare; and <br /> 3- This ordinance promotes the best long-term interests of the <br /> Everett community; <br /> Now, Therefore, The City of Everett Does Ordain: <br /> Section 1 : Purpose. <br /> The City Council finds that the City of Everett in relation to <br /> Snohomish County and most other cities within the County has <br /> traditionally provided for the siting of jails, correctional <br /> facilities and class II group-care homes which serve the needs of <br /> the County, region and State. As a result of this, the City now <br /> has a disproportionate share of such facilities . The County and <br /> other cities within the County must accept their fair share of <br /> such facilities and not permit this over concentration of jails, <br /> correctional facilities and class II group-care homes to <br /> perpetuate itself in Everett. <br /> Section 2 : Jails, Correctional Facilities and Class II Group- <br /> Care Homes . <br /> Ordinance No. 1671-89 (Title 19 EMC) is amended by the addition <br /> of the following chapter: <br /> JAILS, CORRECTIONAL FACILITIES, CLASS II GROUP-CARE HOMES <br /> A- For purposes of the Everett zoning code, "jails and <br /> correctional facilities" are defined as public or private <br /> facilities providing for the confinement of juvenile offenders, <br /> for the incarceration, confinement or detention of individuals <br /> arrested for or convicted of a crime, or for the punishment <br /> correction and/or rehabilitation of individuals convicted of <br /> crimes whose freedom is restricted. The term "jails and <br /> correctional facilities" includes those group-care homes, Class <br /> II (as defined in EMC 19. 04 . 020 including subclassifications II- <br /> A, II-B and II-C) which are exempt from the provisions of the <br /> Federal Fair Housing Act Amendments of 1988 and the Washington <br /> Housing Policy Act (RCW 35. 63.220) . <br /> 3 <br />
