Section 18. Section 22.020.A of Ordinance#1671-89, as amended by Section 13 of Ordinance <br /> #1729-90, (EMC 19.22.020.A)which reads: <br /> A. Setbacks. <br /> 1. There shall be no minimum setbacks in the B-3 zone except as provided in <br /> Subsections 22.020.A.2 and 22.020.A.3. However, except as provided in Subsection a. <br /> of this paragraph, all buildings constructed after the effective date of this Ordinance shall <br /> be required to be built up to the property line abutting a public street for a minimum of <br /> 70 percent of the full property frontage(s). For multiple story structures, the street level <br /> floor may be recessed from the property line if the next floor above is built to the <br /> property line. For purposed of this Section, "constructed" shall mean new construction <br /> or expansions of existing buildings which involve more than the lesser of 10,000 square <br /> feet gross floor area, or 50% of the floor area of the existing building. Exceptions to the <br /> setback requirements of this paragraph shall be permitted under the following <br /> circumstances: <br /> a. For expansions which exceed the lesser of 10,000 square feet of 50% of the <br /> gross floor area of the existing structure, the applicant may propose an <br /> alternative standard pursuant to the provisions of Section 22.020.F. The <br /> Planning Director or Planning Commission, in addition to considering the criteria <br /> stated in Section 22.020.F shall make the following findings if the expansion is <br /> approved: <br /> i) The application of the setback standards of Section 22.020.A.I would <br /> be detrimental to the design of the existing building and site development; <br /> and <br /> ii) The alternative design proposed will bring the existing building and <br /> site development into closer conformity with the requirement of the zoning <br /> code. <br /> b. Expansions which do not exceed the lesser of 10,000 square feet or 50% of <br /> the gross floor area of the existing building shall be permitted provided that the <br /> expansion does not create a greater nonconformity with the requirements of <br /> Section 22.020.A.1 or other applicable zoning code requirements. <br /> 2. For development sites with a street frontage of more than 100 feet, the <br /> Planning Director may authorize setbacks from the street frontage property lines <br /> up to a maximum of 50 percent of the property frontage if such area is devoted <br /> entirely to a landscape feature, plaza, courtyard or other people oriented <br /> permanent focal point intended to substantially enhance the appearance of the <br /> building and provide an area for people to informally gather, sit and interact. Such <br /> features may also be used to satisfy the requirements for floor area bonus <br /> incentives described in Subsection 22.020.D. <br /> 3 <br />
