114 <br />ORDINANCE NO. <br />AN ORDINANCE amending Section 29 of Ordinance 2442-00, Everett <br />Municipal Code 9.06.208, (Trespass in Parks — Punishment) to revise the <br />operating hours of city parks and authorize the Parks and Recreation <br />Director to modify operating hours where deemed appropriate. <br />WHEREAS, section 29.B of Ordinance 2442-00 (EMC 9.06.208) states that "unless <br />otherwise posted, city parks are open to the public from six a.m. to ten p.m. The parks <br />are closed to public use from ten p.m. to six a.m."; and <br />WHEREAS, services offered by the City of Everett Parks Department includes activities <br />and events where customers are in city parks past the posted closing time; and <br />WHEREAS, efficient operations and management of city parks can be improved through <br />the establishment and posting of seasonal park operating hours; and <br />WHEREAS, there are special circumstances which may require the city parks be open or <br />closed outside of seasonal park operating hours; and <br />WHEREAS, the ability to manage city parks to improve customer service can be <br />enhanced through the establishment of authority to the Parks and Recreation Director to <br />modify the time when a city park is open to the public where deemed appropriate. <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1• <br />Section 29 B. of Ordinance 244-00 (EMC 9.06.208 B.) which reads as follows: <br />B.
