5 <br /> Swale with a Tightline as provided below; and (c) controlling entry and placing <br /> any conditions on entry of stormwater from third parties to the Stormwater <br /> Conveyance System. The Parties may allow third parties to use the Stormwater <br /> Conveyance System, provided any such third party agrees to manage its property <br /> in a manner consistent with the requirements on the Parties set forth in Section 2 <br /> and preserves capacity for the Parties' use of the facilities. <br /> 1.2.3 Tightline <br /> The Parties agree to replace the Swale with a Tightline to be owned and <br /> operated by the City, preferably in 2008. The Tightline will be located proximate <br /> to the existing Swale location. The Tightline will be designed, permitted, and <br /> constructed by either party, subject to review and approval by the other party <br /> through the Riverside Environmental Team ("RET") process, which approval <br /> shall not be unreasonably withheld. The Tightline may be sized to handle <br /> projected flows of the parties from current and future development. K-C will <br /> grant an easement to the City for any portion of the Tightline located on K-C <br /> property, substantially in the form attached as Exhibit C to this Agreement. If <br /> K-C constructs any portion of the Tightline, K-C will dedicate such portion of the <br /> Tightline to the City upon construction, which shall then be a City utility and will <br /> be managed and operated as such. If a third party requests or requires <br /> modification of the Tightline, the City will review any such plans in consultation <br /> with K-C. <br /> 1.3 Lift Station Operations <br /> The Lift Station is on City property and is solely owned and operated by the City. <br /> The City will manage and operate the Lift Station as a City utility facility able to handle <br /> flow from the Conveyance Facility. <br /> 2. Permits <br /> 2.1 Individual Facilities <br /> Each Party will be responsible for obtaining any state and local permits required <br /> for the construction and operation of those facilities related to the stormwater collection <br /> and conveyance system that are developed on each Party's respective properties. Each <br /> Party will also be responsible for consulting with the City's Utilities Department and <br /> obtaining, for any development on each Party's respective properties, any discharge <br /> 4 1 � <br />
