5 <br /> One Party may perform maintenance on the other Party's individual facilities as provided <br /> in this Agreement. One Party shall commence maintenance work immediately at the <br /> request of the other Party if a demonstration of detrimental impacts to the Party or its <br /> drainage facilities is shown. Each Party's work must comply with the current best <br /> management practices for stormwater per the current version of the City of Everett <br /> adopted portions of the Department of Ecology's Stormwater Management Manual for <br /> Western Washington, or as set by the Management Committee. Each Party's work and <br /> system must comply with all then current applicable regulations and permits. <br /> Upon reasonable request, each Party will promptly provide the other Party with <br /> copies of any permits, any inspection or monitoring information, or any other information <br /> the Party may have on the quality and quantity of stormwater that drains to the <br /> Conveyance Facility. Parties shall not charge each other for these copies unless they are <br /> voluminous, in which case the cost shall become part of the shared cost under Sections <br /> 3.2 and 4. <br /> 1.2 Riverside Drainage Swale & Conveyance Facility <br /> The Parties will manage the existing and future Conveyance Facility as follows <br /> and will share costs as specified in Section 3 below. <br /> 1.2.1 Management of Existing Swale <br /> As long as the Swale exists, the Parties will jointly manage the existing <br /> Swale so that the Swale functions properly, complies with applicable stormwater <br /> best management practices, and complies with the Clean Water Act and other <br /> regulations. Maintenance will also take into consideration the need for separation <br /> from other sources of stormwater, site access control, maintenance, <br /> removal/management of vegetation and sedimentation, and inspection/ <br /> monitoring/reporting. The Swale maintenance schedule and activities will be as <br /> described in the Riverside Stormwater Maintenance Plan(Exhibit B). <br /> 1.2.2 Modification of Drainage Swale <br /> Through the Management Committee established in Section 5 of this <br /> 1 5 Agreement, the Parties will cooperate in: (a) reviewing and approving any <br /> substantial modifications to the design or location of the Swale; (b) replacing the <br /> 3 <br />
