5 <br /> 3.2 Jointly Managed Facilities <br /> Each Party will be responsible for its share of the costs related to executing the <br /> Maintenance Plan as it pertains to Swale (Section 1.2) and any other Jointly Managed <br /> Facilities unless otherwise agreed to in advance by the Management Committee. The <br /> parties agree to share these costs according to the following allocation schedule: <br /> City: 50% K-C: 50% <br /> 3.3 Tightline <br /> Each Party will be responsible for the following share of the costs for designing, <br /> permitting, and constructing the Tightline. If one Party requests the Tightline be sized at <br /> a higher capacity that results in substantial additional costs, the Management Committee <br /> will determine an equitable adjustment in the cost-sharing (which may be made by <br /> reimbursement for costs, change in percentage, or other method to accomplish a true-up). <br /> City: 50% K-C: 50% <br /> 3.4 Lift Station Facilities <br /> The City is responsible for maintaining and operating this facility, including any <br /> modifications to or replacement of the Lift Station. <br /> 3.5 In-House and Third Party Cost Sharing <br /> Maintenance of each Party's facilities can be performed by the Party's own staff, <br /> by a third party, or the other Party's staff at compensation rates (City costs are per EMC <br /> 14.16.168) and cost sharing proration agreed to in writing by the Management Committee <br /> in advance. Such agreement may be part of the budget process. Each Party will be <br /> responsible for training employees or contractors on the property operation and <br /> maintenance of each Party's respective facility. The Parties may charge a third party user <br /> a fee or a share of the cost which may lower or defray the Parties' cost-sharing in <br /> Section 3 and shall be figured into the budget process set forth in Section 4. <br /> 3.6 Utility Costs <br /> Costs for discharging wastewater into the Swale or Tightline and having the <br /> discharge pumped and treated by Everett's POTW will be per the then current City of <br /> Everett Ordinance rates for sewer and surface water for industrial users as approved by <br /> City Council.
