`` <br /> AMENDMENT ONE <br /> to <br /> PROFESSIONAL SERVICES AGREEMENT <br /> for <br /> DESIGN OF THE EVERETT PERFORMING ARTS CENTER DOWNTOWN PLAZA <br /> with <br /> NAKANO ASSOCIATES,LLC <br /> This AGREEMENT,entered into the day of April 2008, constitutes Amendment No. 1 to <br /> the"Agreement"between the City of Everett, "the CITY"and Nakano Associates, LLC herein <br /> after called the"CONSULTANT',entered into on the 8th day of October, 2007. <br /> WITNESSETH: <br /> WHEREAS, Section 8.0 of the Agreement provides for adjustment or modification of the <br /> Agreement by mutual consent of the CITY and the CONSULTANT; and <br /> WHEREAS, The City entered into a professional services agreement with the Consultant to <br /> provide final design work including demolition plans, street and drainage details,lighting and <br /> electrical plans, planting and irrigation plans,hardscape and landscape details,cost estimates, <br /> presentations,construction plans,bid documents and details for the Everett Performing Arts Center <br /> Downtown PIa72 for the Parks and Recreation Department;and <br /> WHEREAS,the City has requested that the CONSULTANT assist in the preparation of <br /> construction documents for integrated plaza design elements as provided by the project artist;and <br /> WHEREAS,the City has requested that the CONSULTANT perform lighting design and <br /> electrical work for the exterior of the Key Bank building and supplemental lighting for the plaza <br /> respectively;and <br /> WHEREAS,the City and CONSULTANT agree that an additional fee is necessary to perform <br /> this work to include City/Consultant coordination, design and specifications development; and <br /> WHEREAS,the CITY and the CONSULTANT have mutually agreed that there shall be no <br /> changes in the completion date. <br /> NOW, THEREFORE,the CITY and the CONSULTANT mutually agree as follows: <br /> Section 1 of the Agreement is modified to change"Exhibit A—Scope of Work"to"Exhibit A <br /> and A-I —Scope of Work." <br /> Section 4B of the Agreement is modified to change"Exhibit B Compensation"to"Exhibit B and <br /> B-1 Compensation." <br /> Q Section 4D of the Agreement is modified to change the total compensation,including all services <br /> and expenses from a not to exceed a maximum of One Hundred Ninety Six Thousand One <br /> 1 <br />
