• <br /> 1.7 The environment of services and protections that the City provides, such as the <br /> City's system of solid waste, including solid waste facilities, assists private entities in handling <br /> solid waste in the City. Taxes levied on the handling of solid waste in the City benefit the City's <br /> and County's entire solid waste system. <br /> 1.8 An excise on solid waste handling facilities is a fair and equitable means of raising <br /> revenue to fund City services, including general fund services and any general fund support for <br /> solid waste management activities. <br /> 1.9 This Ordinance creates a new chapter in Title III, Everett Municipal Code and <br /> imposes an excise on all solid waste handling facilities within the city. However, county-owned <br /> solid waste handling facilities are exempted from City taxes under RCW 36.58.080. <br /> 1.10 This Ordinance constitutes an exercise of the City's authority to levy excises for <br /> revenue, and not an exercise of the City's regulatory authority. Nothing in this Ordinance shall be <br /> construed to preclude the City's imposition of impact fees or charges on publicly owned or <br /> operated solid waste handling facilities, including environmental mitigation charges, directly <br /> attributable to such solid waste facilities. <br /> SECTION 2: DEFINITIONS The following definitions are applicable to this <br /> chapter only, and are intended to define taxable or nontaxable activities only. <br /> 2.1 Solid Waste means all putrescible and nonputrescible solid or semi-solid wastes, <br /> including, but not limited to, garbage, rubbish, ashes, residential wastes, industrial wastes, <br /> commercial wastes, hazardous waste, dangerous waste, biomedical wastes, swill, demolition and <br /> construction wastes, abandoned vehicles, or parts thereof. <br /> 2.2 Handling Facility means any facility, or part thereof, for management or handling of <br /> Solid Waste, including but not limited to, transfer stations, material recycling facilities, facilities <br /> for loading or unloading of sealed containers of Solid Waste. "Handling Facilities" excludes <br /> trucks or equipment for collection from households and businesses. "Handling Facilities" <br /> excludes disposal sites. "Handling Facilities" may include facilities not subject to permit <br /> jurisdiction of the Snohomish Health District. <br /> 2.3 Person means persons of either sex, firms, partnerships, corporations or other <br /> business entities acting by themselves or by servants, agents of employees. <br /> SECTION 3: EXCISE There is hereby levied on every person operating within the <br /> City a Handling Facility, or any part thereof, a fee of One Dollar and Seventy Cents ($1.70) per <br /> ton of Solid Waste handled in said Facility. <br /> 2 <br />
