• <br /> EV. <br /> ORDINANCE NO. 2075-95 <br /> AN ORDINANCE providing for the adoption of the 1994 Edition of the Uniform <br /> Fire Code and the Uniform Fire Code Standards, and repealing Ordinance <br /> No. 1880-92. <br /> WHEREAS, the City Council finds that this ordinance serves to protect the public health <br /> and safety; and <br /> WHEREAS, the City Council finds that the absence of the regulations adopted by this <br /> ordinance would create a public harm and a public nuisance; and <br /> WHEREAS, the City Council finds that the City is mandated by the State to implement <br /> and enforce the herein adopted code; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: This Ordinance shall be known as the "Everett Fire Code." <br /> Section 2: There is hereby established in the City of Everett, the Fire Department <br /> which shall be under the jurisdiction of the Fire Chief, designated by the Mayor. <br /> Section 3: The Uniform Fire Code, Volume 1, (hereinafter referred to as The Uniform <br /> Fire Code or"UFC"), including Appendices I-A, I-B, I-C, II-B, II-C, II-E, II-F, III-A, III- <br /> B, III-C, IV-B, V-A, VI-A, VI-B, VI-D, VI-E, VI-F, VI-G, and the Uniform Fire Code, <br /> Volume 2, (hereinafter referred to as The Uniform Fire Code Standards or "UFCS"), <br /> published by the International Fire Code Institute, being particularly the 1994 Editions as <br /> amended by Chapters 51-34 and 51-35 WAC thereof and the whole thereof, save and <br /> except such portions as are hereinafter deleted, modified or amended are hereby adopted by <br /> reference and incorporated herein as fully as if set out at length herein. <br /> Section 4: Section 103.1.4 of the 1994 Edition of the UFC is hereby amended by <br /> deleting: <br /> To determine the suitability of alternate materials and types of construction and to <br /> provide for reasonable interpretations of the provisions of this code, there shall be <br /> and hereby is created a board of appeals consisting of five members who are <br /> qualified by experience and training to pass judgment upon pertinent matters. The <br /> chief shall be an ex officio member and shall act as secretary of the board. The <br /> board of appeals shall be appointed by the executive body and shall hold office at <br /> their pleasure. The board shall adopt reasonable rules and regulations for <br /> conducting its investigations and shall render decisions and findings in writing to <br /> the fire chief, with a duplicate copy to the appellant. <br /> 1 <br />
