• <br /> and inserting in its place: <br /> In order to determine the suitability of alternate materials and methods of <br /> construction, to provide for reasonable interpretations of this code, and to hear <br /> appeals from written orders issued by the City's Fire Marshal, the board of appeals <br /> created pursuant to Ordinance No. 351-75 shall hear these matters. Appeals from <br /> written orders of the fire marshal must be filed within thirty (30) calendar days <br /> from the date of receipt of the written order by the aggrieved party. The aggrieved <br /> party shall cause to be made at his own expense, any tests or research required to <br /> substantiate his claim. <br /> Section 5: Section 7801.3.1.2 of the 1994 Edition of the UFC is hereby amended by <br /> the addition of the following section: <br /> Except as hereinafter provided or as is otherwise provided by State law and City <br /> Ordinance, it shall be unlawful for any person to possess, store, to offer for sale, <br /> expose for sale, sell at retail or use or explode any fireworks, provided that the <br /> Chief shall have power to adopt reasonable rules and regulations for the granting of <br /> permits for supervised public displays of fireworks by a jurisdiction, fair <br /> association, amusement park, other organization or for the use of fireworks by <br /> artisans in pursuit of their trade. Every such use or display shall be handled by a <br /> competent operator approved by the Chief and shall be of such character and so <br /> located, discharged or fired so as, in the opinion of the Chief after proper <br /> investigation, not to be hazardous to property or endanger any person. <br /> Section 6: Appendix I-A, 1. General, of the 1994 Edition of the UFC is hereby <br /> amended by deleting: <br /> 1.2 Effective Date. Within 18 months after the effective date of Appendix I-A, <br /> plans for compliance shall be submitted and approved, and within 18 months <br /> thereafter the work shall be completed or the building shall be vacated until made to <br /> conform. <br /> and inserting in its place: <br /> 1.2 Effective Date. Within eighteen (18) months after notification by the Fire Chief <br /> to the owner or the occupant or tenant of the adoption of this appendix, plans for <br /> compliance shall be submitted and approved, and within three (3) years, or as <br /> approved by the Fire Chief, thereafter the work shall be completed or the building <br /> shall be vacated until made to conform. <br /> Section 7: The 1994 Edition of the UFC is amended by the addition of the following <br /> section: <br /> Any person, firm, or corporation violating any of the provisions of this code, shall <br /> be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of <br /> a separate offense for each and every day or portion thereof during which any <br /> violation of any of the provisions of this Code is committed, continued or <br /> permitted, and upon conviction of any such violation, such person shall be <br /> punishable by a fine of not more than one thousand dollars ($1,000) or by <br /> imprisonment for not more than ninety (90) days or by both such fine and <br /> imprisonment. <br /> 2 <br />
