• and inserting in its place: In order to determine the suitability of alternate materials and methods of construction, to provide for reasonable interpretations of this code, and to hear appeals from written orders issued by the City's Fire Marshal, the board of appeals created pursuant to Ordinance No. 351-75 shall hear these matters. Appeals from written orders of the fire marshal must be filed within thirty (30) calendar days from the date of receipt of the written order by the aggrieved party. The aggrieved party shall cause to be made at his own expense, any tests or research required to substantiate his claim. Section 5: Section 7801.3.1.2 of the 1994 Edition of the UFC is hereby amended by the addition of the following section: Except as hereinafter provided or as is otherwise provided by State law and City Ordinance, it shall be unlawful for any person to possess, store, to offer for sale, expose for sale, sell at retail or use or explode any fireworks, provided that the Chief shall have power to adopt reasonable rules and regulations for the granting of permits for supervised public displays of fireworks by a jurisdiction, fair association, amusement park, other organization or for the use of fireworks by artisans in pursuit of their trade. Every such use or display shall be handled by a competent operator approved by the Chief and shall be of such character and so located, discharged or fired so as, in the opinion of the Chief after proper investigation, not to be hazardous to property or endanger any person. Section 6: Appendix I-A, 1. General, of the 1994 Edition of the UFC is hereby amended by deleting: 1.2 Effective Date. Section 7: The 1994 Edition of the UFC is amended by the addition of the following section: Any person, firm, or corporation violating any of the provisions of this code, shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued or permitted, and upon conviction of any such violation, such person shall be punishable by a fine of not more than one thousand dollars ($1,000) or by imprisonment for not more than ninety (90) days or by both such fine and imprisonment. 2
