Nothing contained in this code is intended to be nor shall be construed to create <br /> or form the basis for any liability on the part of the City, or its officers, <br /> employees or agents, for any injury or damage resulting from the failure of a <br /> building to comply with the provisions of this Code, or by reason or in <br /> consequence of any inspection, notice, order, certificate, permission or approval <br /> authorized or issued or done in connection with the implementation or <br /> enforcement of this Code, or by reason of any action or inaction on the part of <br /> the City related in any manner to the enforcement of this Code by its officers, <br /> employees or agents. <br /> Notwithstanding any language used in this Code, it is not the intent of this Code <br /> to create a duty and/or cause of action running to any individual or identifiable <br /> person but rather any duty is intended to run only to the general public. <br /> B. Section 203 of the Uniform Code for the Abatement of Dangerous Buildings, <br /> 1994 Edition, is hereby amended by the addition of the following: <br /> Any person, firm or corporation violating any provision of this Code shall be <br /> deemed guilty of a misdemeanor and, upon conviction thereof, shall be <br /> punishable by a fine not to exceed one thousand dollars ($1,000) or by <br /> imprisonment in jail not to exceed ninety (90) days, or both fine and <br /> imprisonment. Each separate day or any portion thereof, during which any <br /> violation of this Code occurs or continues, shall be deemed to constitute a <br /> separate offense and, upon conviction thereof, shall be punishable as herein <br /> provided. The issuance or granting of a permit or approval of plans and <br /> specifications shall not be deemed or construed to be a permit for, or an <br /> approval of, any violation of this code. No permit presuming to give authority <br /> to violate or cancel the provisions of this Code shall be valid, except insofar as <br /> the work or use which it authorized is lawful. <br /> C. Section 205.1 of the Uniform Code for the Abatement of Dangerous Buildings, <br /> 1994 Edition, is hereby amended by deleting: <br /> Board of Appeals <br /> Section 205.1 General. In order to hear and decide appeals of orders, decisions <br /> or determinations made by the Building Official relative to the application and <br /> interpretations of this code, there shall be and is hereby created a Board of <br /> Appeals consisting of members who are qualified by experience and training to <br /> pass upon matters pertaining to building construction and who are not <br /> employees of the jurisdiction. The Building Official shall be an ex officio of <br /> and shall act as secretary to said board but shall have no vote upon any matter <br /> before the board. The Board of Appeals shall be appointed by the governing <br /> body and shall hold office at its pleasure. The Board shall adopt rules of <br /> procedure for conducting its business and shall render all decisions and findings <br /> in writing to the appellant, with a duplicate copy to the Building Official. <br /> Appeals to the board shall be processed in accordance with the provisions <br /> contained in Section 501 of this code. Copies of all rules or regulations adopted <br /> by the board shall be delivered to the Building Official, who shall make them <br /> freely accessible to the public. <br /> 2 <br />
