• <br /> c) Notwithstanding paragraph (b), the City Attorney is authorized to apply <br /> to any court of competent jurisdiction for and such court, upon hearing <br /> and for cause shown, may grant a temporary or permanent injunction <br /> restraining any person, firm and/or corporation from violating any <br /> provision of this Code and compelling compliance herewith. The cost of <br /> such action shall be taxed against the violator. <br /> d) A conviction of any person, firm or corporation for violating this Code <br /> shall not impede the authority granted in this section to the City Attorney <br /> or City. <br /> Section 3: This ordinance shall not be construed nor held to repeal Ordinance No. <br /> 1886-92 as to any offense committed against such former ordinance or as to any act <br /> done, any penalty, forfeiture or punishment so incurred, or any right accrued or claim <br /> arising under the former ordinance, or in any way whatever to affect any such offense <br /> or act so committed or so done, or any penalty, forfeiture or punishment so incurred or <br /> any right accrued or claim arising before this ordinance takes effect. <br /> Nothing contained in this section shall be constructed as abating any action now <br /> pending under or by virtue of Ordinance No. 1886-92; or as discontinuing, abating, <br /> modifying or altering any penalty accrued or to accrue, or as affecting the liability of <br /> any person, firm or corporation, or as waiving any right of the City under Ordinance <br /> No. 1886-92 or provision thereof in force at the time of passage of this Ordinance. <br /> Section 4: The City Council hereby declares that should any section, paragraph, <br /> sentence, clause or phrase of this ordinance or of the Uniform Code for the Abatement <br /> of Dangerous Buildings hereby adopted be declared for any reason to be invalid, it is <br /> the intent of the City of Everett that it would have pas -e all portions of this ordinance <br /> and Code independent of the elimination herefro of y such portion as may be <br /> declared invalid. <br /> e1 <br /> -34 <br /> Carl Gipson, Mayor Pro-Tem <br /> ATTE T: <br /> opt._ <br /> CI CLERK <br /> Passed: 07/05/95 <br /> Valid: 07/07/95 <br /> Published: 07/14/95 <br /> Effective: 07/23/95 <br /> 6 <br />
