W--A* <br /> E1RETT <br /> ORDINANCE NO. 2 0 61-9 5 <br /> An Ordinance Amending the Zoning Map as Established by Ordinance No. 1671-89 <br /> by Rezoning Various Properties to Implement the Comprehensive Plan <br /> Land Use Designations for the 19th Avenue SE Study Area <br /> WHEREAS, the Everett City Council adopted Ordinance No. 2021-94 establishing Everett's <br /> Growth Management Comprehensive Plan on August 3, 1994,pursuant to the Washington State <br /> Growth Management Act; and <br /> WHEREAS, Section 5 of Ordinance No. 2021-94 designated the 19th Avenue SE Study Area as <br /> a special study area and declared the City's intent to adopt the land use designations for this area <br /> as a final phase of comprehensive plan adoption, in order to allow for the completion of a <br /> detailed environmental impact statement(EIS) for a pending plan amendment and rezone and to <br /> allow for further consideration of public testimony for the study area by the Planning <br /> Commission and City Council; and <br /> WHEREAS, the 19th Avenue SE Study Area has a fragmented mix of zoning classifications <br /> which has resulted from changes to the comprehensive plan in 1972, 1983 and 1986-87; and <br /> WHEREAS, the Planning Commission considered five alternative land use patterns for the 19th <br /> Avenue SE Study Area and the development potential which could result from implementation <br /> of each of the land use alternatives; and <br /> WHEREAS, the Planning Commission held public hearings on March 27 and 28, 1995, to <br /> consider public testimony and written comments from Costco representatives, other property <br /> owners within the 19th Avenue SE Study Area, the Silver Lake Action Committee neighborhood <br /> organization, City staff, and the general public in consideration of a final land use plan for the <br /> study area; and <br /> WHEREAS,the City Council has adopted "Alternative D" as the land use plan for the 19th <br /> Avenue SE Study Area, which action supports the Costco rezone request and which is set forth in <br /> Exhibit A which is attached hereto and incorporated herein by reference; and <br /> WHEREAS, the Growth Management Act requires that the City's Zoning Map be consistent with <br /> its adopted Comprehensive Plan Land Use Map and, therefore, the adoption of this zoning <br /> regulation by the City is required by the State of Washington; and <br /> WHEREAS, the absence of this regulation will create a public harm and a public nuisance; and <br />
