If the conditions of this Ordinance and Preliminary Approval have been met, <br /> the Planning and Community Development Director and the City Engineer shall <br /> inscribe and execute their written approval on the face of the Binding Site Plan. <br /> 4. If the Binding Site Plan map does not show all of the lots and the applicant <br /> proposes the Binding Site Plan be developed in divisions, permission to develop <br /> in divisions will be granted by the City under the following conditions: <br /> a. The division of land is consistent with an approved site plan by the City. <br /> Such division can only take place with the filing of a declaration of <br /> condominium under the Horizontal Property Regimes Act, Chapter 65.32 <br /> RCW or the Condominium Act, Chapter 64.34 RCW; and <br /> b. The proposed division is consistent with the approved phasing plan in <br /> which the phase is capable of receiving certification of occupancy or the <br /> total site has received certificate of occupancy by the City; and <br /> c. The new legal description of the proposed lot and the Binding Site Plan <br /> map meets the standards set forth in Section III and all new property <br /> corners are set or found consistent with the survey standards of this <br /> Ordinance. <br /> D. Record with Auditor <br /> When the City finds that the Binding Site Plan proposed for final approval meets <br /> all the conditions of final approval, then the applicant shall record the original of <br /> said Binding Site Plan and all approved divisions with the Snohomish County <br /> Auditor. The applicant will also furnish the City with one reproducible mylar <br /> copy, and the Snohomish County Assessor shall be furnished one paper copy. <br /> After this is done, the applicant must provide the City with proof of proper filing <br /> and recording before the Binding Site Plan becomes valid. <br /> E. Development <br /> All development must be in conformance with the recorded Binding Site Plan. <br /> 15 <br />
