C. Purpose <br /> It is the intent and purpose of this Ordinance to establish an alternative process <br /> to subdividing and short subdividing of land as provided in the City's Subdivision <br /> Ordinance. The Binding Site Plan review process includes a division of land <br /> based on a development plan contained in an underlying land use permit or <br /> approval, which plan is a site plan approved by the City in accordance with EMC <br /> Titles 18, 19, and 20 (site plan or approved site plan). The Binding Site Plan will <br /> promote the harmonious development of such properties in a manner that will <br /> have the most beneficial relationship between the development of the land and <br /> such matters as the circulation of traffic, the effective use of utilities, adequate <br /> landscaping, parking, loading, refuse disposal, outdoor storage, and pedestrian <br /> flow. <br /> D. Jurisdiction <br /> The Binding Site Plan process is an alternative process for subdividing property <br /> located in business, commercial, industrial, and residential zones where the <br /> property to be divided is subject to a declaration of condominium as provided for <br /> in Chapter, 64.32 or 64.34 RCW within the incorporated area of the City. <br /> E. Applicability <br /> Any person, firm, corporation or other entity which does not divide its property <br /> per the City's Subdivision Ordinance and seeks to divide land that is zoned for <br /> business, commercial, industrial, or for residential purposes that is to be <br /> developed with residential condominiums pursuant to Chapter 64.32 or 64.34 <br /> RCW, for the purpose of sale, lease, or transfer of ownership is required to <br /> apply for and complete a Binding Site Plan as is required by this Ordinance. <br /> F. Administration <br /> The Planning and Community Development Director and the City Engineer <br /> shall have the duty and responsibility of administering the provisions of this <br /> Ordinance. <br /> G. Definitions <br /> 1. Applicant. Any person proposing to submit a complete application for a <br /> Binding Site Plan. <br /> 2. Approved Site Plan. A site plan, meeting the standards as specified by the <br /> Planning and Community Development Department application packets, that <br /> has been approved by the City in accordance with Titles 18, 19, and 20 EMC, <br /> as amended. <br /> 3. Binding Site Plan. The division or redivision of land into lots, tracts, parcels, <br /> sites or divisions for the purpose of sale, lease, or transfer of ownership with a <br /> site plan. <br /> 4. Binding Site Plan Map. A final drawing to-scale which: (a) identifies and <br /> shows the areas and locations of all streets, roads, improvements, utilities, open <br /> spaces; (b) any other matters required to be identified by the City, and <br /> containing inscriptions or attachments setting forth such appropriate limitations <br /> 4 <br />
