The City Council authorized a Call for Bids for the excavation and removal of the contamination on May 7, 2008. Bids were opened on June 3, 2008 with nine bids. The bids have been tabulated and are attached. For this bid the bidders were required to specify disposal locations for contaminated soil. The lowest bidder placed conditions on two of the bid items along with his disposal location. The specifications allowfor conditions to be placed on bid items by a bidder but does not obligate the City to accept the bid with conditions. Staff recommends rejecting the lowest bidder and awarding the contract to the second lowest responsive, responsible bidder that has no conditions placed on his bid items. RECOMMENDATION: Reject the low bid from AEC because of conditions placed on two of the bid items. Authorize the Award of the Contract to the second lowest bidder, Clearcreek Contractors, in the sum of$351,342.72. 2
