<br /> DETAILED SUMMARY STATEMENT:
<br /> The City's Agreement with Association of Attorneys for the Accused, Inc. (AAA) for public defender
<br /> services expires June 30, 2008. In anticipation of the expiration of the AAA agreement, the City issued a
<br /> Request for Proposals (RFP) for public defender services in March 2008. Staff's recommendation to the
<br /> Budget Committee was that the City not enter into a new contract based upon that RFP review process (thus
<br /> rejecting all proposals from RFP 2008-025).
<br /> Instead, the City desires to amend its existing agreement with AAA to extend it for one year from July 1,
<br /> 2008 to June 30, 2009, to provide the City adequate time to allow for the adoption of public defender
<br /> standards and to issue a new RFP for public defender services. This Amendment provides for a number of
<br /> adjustments for this interim period including clarifying that the current agreement is a "performance"
<br /> agreement whereby compensation paid to AAA may increase or decrease depending on the volume of
<br /> criminal defense referrals that affect its overhead and attorney requirements under the Agreement. This will
<br /> result in the City realizing approximately $158,000 in savings for the period July 1, 2007, to June 30, 2008.
<br /> With the commencement of this Amendment, the City's monthly payment will be reduced from $108,333 to
<br /> $95,833, subject to adjustment depending upon case load.
<br /> RECOMMENDATION:
