In 2008, the City Council approved an amendment to the <br /> Comprehensive Plan and a Rezone of the ECC athletics property on the north side <br /> of 13th Street for future expansion by PEMC. This action was preceded by an <br /> agreement between PEMC and ECC to exchange properties to provide for the <br /> long term expansion needs of both institutions. The approval of the ECC Property <br /> for PEMC use for hospital and related medical activities is governed by an <br /> Institutional Overlay Zone Master Plan, that includes development standards and <br /> design guidelines to guide the future phasing of development on the property <br /> beyond 2030. No additional expansion of hospital and related medical uses into <br /> abutting residential areas shall be permitted. <br /> Section 2. The property, as described in Exhibit A, is hereby rezoned from R-2 (Single <br /> Family Detached, Medium Density) to R-2I (Institutional Overlay Zone) with a Master <br /> Plan as provided by EMC 19.33B, attached hereto as Exhibit A. For purposes of <br /> establishing the boundaries of the zoning district, all contiguous public right-of-way <br /> abutting the property frontage on 13`l' Street shall be included in the rezone area. <br /> Section 3: The official Institutional Overlay Zone master plan for the combined <br /> Colby Campus and ECC property as approved by City Council shall consist of the <br /> integration of the provisions of Ordinance No. 2850-05, as modified, and the provisions <br /> of this Ordinance. Within six months of the effective date of this ordinance, PEMC <br /> shall prepare for the Planning Director's review and approval a document with text and <br /> graphic illustrations that combines the approvals authorized by Ordinance No. 2850-05, <br /> and subsequently approved minor modifications thereto, with the approvals authorized <br /> by this ordinance, into a single integrated plan. The Planning Director's review is <br /> limited to ensuring that all conditions of approval authorized by each ordinance are <br /> properly integrated into a single internally consistent plan document. The integrated <br /> document, upon approval by the Planning Director, shall then constitute the official <br /> Institutional Overlay Zone master plan for the combined Colby Campus and ECC <br /> property under EMC Chapter 19.33B. <br /> Section 4. Validity. <br /> Should any section, subsection, paragraph, sentence, clause or phrase set forth in this <br /> Ordinance or its application to any person or situation be declared unconstitutional or <br /> invalid for any reason, such decision shall not affect the validity of the remaining <br /> portions of this Ordinance or its application to any other person or situation. The City <br /> Council of the City of Everett hereby declares that it would have adopted this Ordinance <br /> and each section, subsection, sentence, clause, phrase or portion thereof irrespective of <br /> the fact that any one or more sections, subsections, sentences, clauses,phrases or portions <br /> be declared invalid or unconstitutional. <br /> 17 <br />
