• <br /> WHEREAS, the requirements of Section 41.160.B.3 of Ordinance No. 1671-89 will result in <br /> costly notification efforts which can be more effectively implemented through other means of <br /> public outreach; and <br /> WHEREAS, the Planning Commission has conducted a public hearing to review the notification <br /> requirements of the Everett Zoning Code for area-wide rezones and feels that an exception should <br /> be made for the purpose of adopting the new Growth Management Comprehensive Plan and <br /> accompanying zoning changes; and <br /> WHEREAS, Section 42.130.0 of Ordinance No. 1671-89, as amended by Ordinance 1788-91, <br /> reduces the ability of the City Council to make timely and efficient decisions related to rezone <br /> proposals or amendments to the text of the zoning code; and <br /> WHEREAS, the City Council has conducted a public hearing to consider the recommendation of <br /> the Planning Commission and finds the following: <br /> 1. The proposed amendments are consistent with the Everett General Plan; and <br /> 2. The proposed amendments bear a substantial relationship to the public health, <br /> safety and welfare; and <br /> 3. The proposed amendments promote the best long term interests of the Everett <br /> community. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 41.160.B.3 of Ordinance No. 1671-89, as amended (EMC 19.41.160.B(3)), <br /> which reads: <br /> Notification. Notification shall be the same regardless of which type of rezone is <br /> proposed. Written notice shall be mailed to all owners of property located within 500 feet <br /> of the site boundaries at least ten days prior to the date of public hearing, and notice of the <br /> hearing shall be published at least ten days prior to the date of hearing. Notice shall also <br /> be posted in two conspicuous locations on or near the site at least ten days prior to the <br /> public hearing. <br /> is hereby amended to read: <br /> Notification. Notification for rezones shall be provided as specified herein: <br /> a. Site-specific rezones: Written notice shall be mailed to all owners of <br /> property located within 500 feet of the site boundaries at least ten days prior to the <br /> date of public hearing, and notice of the hearing shall be published at least ten days <br /> prior to the date of hearing. Notice shall also be posted in two conspicuous <br /> locations on or near the site at least ten days prior to the public hearing. <br />
