• <br /> b. Area-wide rezones: Except as provided in subsection c. of this Section, <br /> written notice shall be mailed to all owners of property located within 500 feet of <br /> the site boundaries at least ten days prior to the date of public hearing, and notice <br /> of the hearing shall be published at least ten days prior to the date of hearing. <br /> Notice shall also be posted in two conspicuous locations on or near the site at least <br /> ten days prior to the public hearing. <br /> c. Area-wide rezones required to ensure compliance with the Growth <br /> Management Act: When area-wide rezones are required in order for the City to <br /> implement the requirements of the Growth Management Act in adopting or <br /> updating the comprehensive plan, written notice shall be mailed to owners of all <br /> properties proposed to be rezoned at least ten days prior to the date of hearing. <br /> The City shall also publish notice of the proposed rezone at least ten days prior to <br /> the date of hearing. This subsection, subsection c of Section 41.160.B.3, shall <br /> expire on December 31, 1994. After December 31, 1994, the notice provisions in <br /> subsection b fo Section 41.160.B.3 shall apply to area-wide rezones. <br /> Section 2: Section 42.130.0 of Ordinance No. 1671-89, as amended by Section 1 of Ordinance <br /> No. 1788-91 (EMC 19.42.130.C), which reads: <br /> Planning Commission Action - Referral to City Council. All actions taken by the Planning <br /> Commission under paragraphs A or B of this Subsection take the form of a <br /> recommendation to the City Council. In reviewing the recommendation of the Planning <br /> Commission, the City Council shall have the authority to take either of the following <br /> actions: <br /> 1. In reviewing the recommendations of the Planning Commission as it relates to actions <br /> identified in paragraph A, the City Council shall have the authority approve the proposal, <br /> sections or subsections thereof. If the City Council wishes to make changes to the <br /> proposal, sections or subsections thereof, it shall remand those portions of the proposal <br /> about which it has concerns to the Planning Commission for further consideration. Upon <br /> referral of the matter back to the City Council, the City Council may approve, disapprove <br /> or modify the proposal. <br /> 2. In reviewing the recommendation of the Planning Commission as it relates to actions <br /> identified in paragraph B, the City Council shall have the authority to approve the <br /> recommendation, of if it disagrees with the recommendation, it shall remand the proposal <br /> to the Planning Commission for further consideration. Upon referral of the matter back to <br /> the City Council, the City Council may approve, disapprove or modify the proposal. <br /> is hereby amended to read: <br /> Planning Commission Action - Referral to City Council. All actions taken by the Planning <br /> Commission under paragraphs A and B of this subsection take the form of a <br /> recommendation to the City Council. In reviewing the recommendation of the Planning <br /> Commission, the City Council shall have the authority to approve, disapprove or modify <br /> the proposal in whole or in part, or remand the portions of the proposal about which it has <br /> concerns to the Planning Commission for further consideration. <br />
