• <br /> 4441/.. <br /> .L1 ERETT <br /> ETT <br /> ORDINANCE No. 1999-94 <br /> An Ordinance of the City of Everett Rezoning Certain Property <br /> Located north of Rim Drive and Shadow Wood Drive <br /> From A-1 (Agricultural) to R-S (Suburban Residential) <br /> WHEREAS, Robert Alger and Russ and Jennifer Juckett have applied for an amendment to the land use <br /> designation of the Everett General Plan and a rezone for property located north of Rim Drive and <br /> Shadow Wood Drive in the Eastmont area, the legal description of which is: <br /> The south half of the south half of the southeast quarter of the southeast quarter of Section 8, <br /> Township 28 North, Range 5 East, W.M., located in Snohomish County, Washington. <br /> ; and <br /> WHEREAS, the applicants propose to subdivide the subject property in order to develop single family <br /> detached housing in accordance with the R-S zone and other applicable standards of the Everett Zoning <br /> Code; and <br /> WHEREAS, the Planning Commission held public hearings on March 15, 1994 to consider the proposed <br /> land use change and rezone and to take public testimony from area residents and property owners and did <br /> consider the relevant policies of the Everett General Plan residential land use policies, land uses in the <br /> vicinity, testimony of the public and the applicant; and <br /> • WHEREAS, the Planning Commission has recommended that the City Council approve the proposed <br /> rezone of the subject property from A-1 (Agricultural)to R-S (Suburban Residential); and <br /> WHEREAS, the City Council held a public hearing on April 13, 1994, to consider the recommendation of <br /> the Planning Commission; and <br /> WHEREAS, the City Council finds that the proposed R-S zoning satisfies the non-project rezone criteria <br /> contained in Section 41.160.D.4 of the Zoning Code: <br /> 1. The proposed R-S zoning is consistent with the proposed change in the land use designation of <br /> the 1986 General Plan Land Use Map, which is consistent with the General Plan policies for single <br /> family detached housing. <br />
