By providing the opportunity for more owner occupied housing that is subject to the standards of the R-S zone and Section 37 of the zoning code(Environmentally Sensitive Areas), the proposed zoning promotes the best long term interests of the Everett community and provides a substantial relation to the public welfare; and 3. The proposed rezone to R-S is necessary to implement the change to the Land Use Map recommended by the Planning Commission. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: The zoning of the above described property is hereby changed from A-1 to R-S. Section 2: The City Clerk is hereby instructed to file a duly certified copy of this Ordinance with the Auditor of Snohomish County, Washington. Section 3: Severability. If any section, subsection, clause, phrase or any portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Everett hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional.
