WHEREAS, the City Council finds that the proposed R-1(A) zoning satisfies the non-project rezone criteria contained in Section 41.160.D.4 of the Zoning Code: 1. The proposed R-1(A) zoning is consistent with the proposed change in the land use designation of the 1986 General Plan Land Use Map, which is consistent with the General Plan policies and locational criteria for single family attached housing. 2. By providing the opportunity for more affordable, owner occupied housing that is subject to the zoning standards of the R-1(A)zone, the proposed zoning promotes the best long term interests of the Everett community and provides a substantial relation to the public welfare; and 3. The proposed rezone to R-1(A) is necessary to implement the change to the Land Use Map being recommended by the Planning Commission. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: The zoning of the above described property is hereby changed from R-S to R-1(A). Section 2: The City Clerk is hereby instructed to file a duly certified copy of this Ordinance with the Auditor of Snohomish County, Washington. Section 3: Severability. If any section, subsection, clause, phrase or any portion of this ordinanceis for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Everett hereby declares that it would have adopted this ordinanceand each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional.
