(2) A division made by testamentary <br /> provisions, or the laws of descent; <br /> (3) Boundary line adjustments pursuant <br /> to the City Boundary Line <br /> Adjustment Ordinance; <br /> (4) A division which is made by <br /> subjecting a portion of a parcel or <br /> tract of land to Chapter 64 . 32 RCW <br /> (Horizontal Property Regimes Act) <br /> if the City has approved a binding <br /> site plan for all such land; <br /> (5) A division of land into lots, <br /> tracts or parcels classified for <br /> business, commercial and industrial <br /> use pursuant to the City' s Binding <br /> Site Plan Ordinance; <br /> (6) A division for the purposes of <br /> lease when no residential structure <br /> other than mobile homes or travel <br /> trailers are to be placed upon the <br /> land when a binding site plan has <br /> been approved by the City for the <br /> use of the land, pursuant to Title <br /> 17 EMC, Mobile Home Parks; and <br /> (7) A division or redivision of land <br /> into nine (9) or fewer lots, <br /> tracts, parcels, site or divisions <br /> for the purpose of sale, lease or <br /> transfer of ownership provided it <br /> is done in accordance with the <br /> short subdivision requirements of <br /> this Ordinance. <br /> B. The provisions of this Ordinance as they <br /> relate to short subdivisions shall not <br /> apply to: <br /> (1) Cemeteries and other burial plots <br /> while used for that purpose; <br /> (2) A division made by testamentary <br /> provisions, or the laws of descent; <br /> (3) Boundary line adjustments pursuant <br /> to the City Boundary Line <br /> Adjustment Ordinance; <br /> 2 <br />
