3. The Resolution of Intent to Rezone assures that the development of the site will comply <br /> with all applicable City ordinances, regulations and mitigation measures, thereby <br /> promoting the best long terms interests of the Everett community; <br /> NOW, THEREFORE,BE IT RESOLVED that the Everett City Council declares its intent to <br /> rezone property located at 2115 and 2117 W. Mukilteo Blvd., as described in the attached legal <br /> description,which is attached hereto as Exhibit A, from R-S to R-S(PRD), for the purpose of <br /> subdividing the subject property into 13 single-family lots, pursuant to the provisions of Section <br /> 41.160 of Ordinance 1671-89, as amended, and the conditions of this Resolution of Intent. <br /> Council shall, by ordinance, effect such rezone upon being advised that all of the following <br /> conditions and requirements contained in this Resolution have been met: <br /> 1. 1. The lot design/configuration for the PRD/subdivision shall be as shown on the <br /> preliminary plat map on file with the City Planning & Community Development <br /> Department. Any changes in lot design/configuration will require approval both by City <br /> Planning and Public Works Departments. <br /> 2. Final Site Plans: A final site plan must be submitted to the City Planning/Community <br /> Development Department that is in substantial compliance with the approved preliminary <br /> development plan and conditions of approval as stated in the Notice of Decision that is <br /> issued by the Everett City Council. <br /> 3. Final Landscape Plans: Final landscaping plans must be submitted to the City <br /> Planning/Community Development Department for approval. The plans must address the <br /> following: <br /> a. A detailed final plan for the entire site showing width and location of all <br /> landscape buffers, streetscape, location of plant material, specific plant type, size <br /> and quantity; <br /> b. Typical lot detail for each building plan showing front, rear and side yard <br /> plantings, with location of plant material and specific plant type, size and <br /> quantity. Fencing or planting for yard areas will need to be approved by the City <br /> Planning/Community Development Department; <br /> c. A detailed final plan of the landscaped entryways and identification signing. <br /> Note: entryway landscaping shall include existing vegetation along the Mukilteo <br /> Boulevard frontage for the house on lot 13; and, <br /> d. A detailed final plan for the proposed wetponds, which includes fencing and <br /> plantings. <br /> 4. All common landscaped areas and fencing shall be maintained by a Homeowners <br /> Association. A Maintenance Warranty shall be provided in the amount of 100% of the <br /> 2 <br />
