Roberts <br />Director <br />Q' 0u� r,r wq� <br />I_: OCT 2 71998 <br />CITY OF EVERETT <br />Engineering/Public Services <br />I apologize for not responding earlier to questions raised at the neighborhood meeting on <br />September 14. 1 want to respond to all of the issues raised even if a number of them are not <br />within the jurisdiction of the Planning Department. <br />First, thank you for inviting me to attend your neighborhood meeting to discuss the development <br />at 37th and Grand Avenue. I appreciate the strong feelings expressed at the meeting by many <br />of the residents. There were a number of questions asked regarding the project history and <br />current construction activities. I will attempt to briefly address these questions here. <br />1. Notice. As 1 indicated in my comments at the September 14 meeting, the notice <br />procedure is a prescriptive action carefully defined in city codes. City staff must follow the <br />precise notice requirements. We take the public notice process very seriously. When I <br />received a complaint from Ms. Libby Johnson, I met with our staff to review the history of this <br />project. In our review, particular attention was paid to the notice requirements, and we <br />concluded that proper notice was provided for this project. <br />2. Underlying land use. The city's Comprehensive Plan designates the subject property <br />as high density multiple family. The R-4 (High Density Multiple Family) zoning designation has <br />existed on this property since 1967. <br />3. Setback and height requirements. Concerns were expressed regarding appropriate <br />setback of the subject development from single-family residences. The current project meets <br />the city code requirements in existence when the project was submitted to the city. <br />In 1990 the city adopted changes to the code which specified an 80-foot height limit with a <br />reduction to 28 feet when located within 50 feet of a single-family zone. This was the standard <br />in effect when the Grand Avenue project was submitted for review under SEPA. This standard <br />was "vested" with the project submittal, meaning it is the standard the city is obligated to apply <br />to the project. <br />The code amendments adopted July 1, 1998, still allow multiple -family dwellings up to 80 feet in <br />height, but created a greater transition for R-4 zoned multiple -family projects in proximity to <br />single-family zones. The new standard is 28 feet high when located within 50 feet of lots in <br />single-family zones, and 45 feet hight when located between 50 and 200 feet from single-family <br />zones.
