Since the <br />initial phases of my involvmr..nt in this project, Kelly Kahne, the <br />owner, has aought the assistance of an investor in the construction <br />being contemplated. It is a very large project and much .Larger <br />than anvt:hing he has undertaken to date. The result was that he <br />would have preferred to split the profit and the risk. Toward that <br />end, we got involved with various parties since you and I last met. <br />Recently, a man offerred to buy- the project in its entirety. That <br />was not the real desire of Kelly Kahne but it was an acceptable <br />Approach. Non-refundable money was placed by that new purchaser, <br />expressing his earnest intent, and we have been dealing wi`N him, <br />for a short period with the details of the project. Kelly ad I <br />were ready to submit for a building permit but the new owner wishen <br />to make some architectural changes which will delay that submittal. <br />Although you, your people, Ostergaard-Robinson and I reached <br />general agreement on what is acceptable to the work on the roads <br />surrounding the Ai Le, the new owner hue requested that I confirm <br />what was generally agreed no that he feels more comfortable about <br />hi position. Ile wasn't in any of our previous meetings. Thus, I <br />would like to reconfirm what we have dieouseed and what we have <br />hopefully shown on the documents which we were about. to submit; for <br />building permit. I very clearly understand that the eventual <br />submittal may raise some questions which we will need to mutually <br />resolve, but hopefully we have captured what we discussed and <br />agr.eAd in our several meetings. <br />So, I am restating my understanding of what was agreed on how the <br />perimeter of the site was to be handled. On 37th, coming up from <br />Rucker, we agreed to hold the road as close to the south as was <br />mutually reasonable co avoid the property and the trees on the <br />north. A narrow road would be provided. The crown of 37th, at the <br />alley, would be lowered very little so as to not limit access to <br />the north property and to better accomodate the Kahne project.
