. 1.6 P23 AN .25 197 12:00
37th moved meat, the road would be straightened ' rid .iraised to'
improve the sight-distanoe conditions us oars used the road: The
attempt would be to use existing contours and the need for better
visual use of the road, in tandem, to balance out the most
effective condition for the roads and the project. The curvature
of the 37th ant) Grand as they moved went toward Merton was also a
limiting condition on sight -distance. It was mutually agreed that
Kahne would deed some of his property to the City to increase the
radius of the road and, thus, create better visibility. The
combination of greater radius of the roads and the raising of the
road elevations resulted in a lowering of the retaining walls at
that cull", which was another positive fenture of what we were
doing. We also .lowered the general. grade of the site by a minor
amount, so that again lowered the retaining wall heights and aided
in the sight condition. A concern was discussed about the planting
to be required between the retaining walla and the new property
line as it, might affect the visibility around that curve. Since
plantings would be an item to be reviewed by the Planning
Department, you commented that you would be able to get them to
agree to plantings which were compatible with your needs for the
beat sight -distance conditions in relation to the existing site and
rouds. I mentioned that a need had been registered by planning to
put ivy on the retaining wallet so basic g;een existed along that
line already in our minds. The straightening of 37th as it went
west, from the crown at the alley resulted 'in a piece of land, in
the City right-of-way, between the new road and the property line.
I asked If we could trade for the property being deeded to increase
the road radius, but you advised that, such would not be possible.
We would, however, be given the ability to Landscape that area to
be compatible with the project. The sethaok at, the tight curve of
hire newly created road boname small as a result of the Pnr_t. that
Kuhns was deeding land to the City, but that also was riot
considered to he a problem, because of the overall effect to the
benefit of the road system and because there was more that~.
suffioient setback in other locations. If the land was not deeded
to the City, there would be more than sufficient setback. But the
sight-distnnoe conditions would be worse as a result. 'Phis "trade"
nondition was also compatible with Conversations very early in the
project evolution between Steve Black of the architect'e office and
Steve Ingalsbe of Planning in which it was ageed that the setback
requ:irementa would not be Lightly enforced if there was a
reasonable balance to the landscaping setback where greater
landscaping setbacks somewhat offset the losser setback areas.
This condition r.xist.s on the site. Where Gratui comes into 37th at
the north of the site, a low spot would result on the small
triangular piece of private property owned by others. We could
either put road slopes there, or we could buy the land and infill
it. Roast slopen would make a rather worthless and small piece of
property even more worthless. Either condition would be acceptable
to you. I have tried to enter into the sale and we even agreed on
the price, but. Wheeler is really a moving target and nothing has
been ronsumated there... On 38th, from the alley going east to
Ruoker, there is no sidewalk. Tf it were put on the north, the
neighbor would lose usable property, a large retaining wall would
06/26/97 10:37 TX/RX N0.0956 P.003
