That there are exceptional circumstances or conditions <br />applying to the subject property that do not apply to <br />other properties in the same vicinity or zone, specifically: <br />1. F7hile there is sufficient lot area to perniit sub- <br />division into four lots, the existence on a house <br />on an adjacent property precludes the extension of <br />a publically dedicated street (49th St.) to provide <br />frontage i:o the fourth lot. <br />B. That such variance is necessary for the preservation ann <br />enjoyment of a substantial property sight of the appellant <br />possessed by the o�aners of other properties in the same <br />vicinity or zone, ::pecifically: <br />1. That all other things being equal, the applicant <br />has the right to deve).op tliis pr.operty into four <br />parcel.s except for the frontage requirement, said <br />requirement being impossible to iulfill because of <br />the adjacent house. <br />C. That the authorization of such variance will not be <br />materially detrimental to the puUlic �velfare or injuriaus <br />to proper{:y in the vicinity, specifi.cally: <br />1. Other properiies will ]�e no more affected hy this <br />proposal then by a situation wher� all four lots <br />fronted on a publically dedi.cated street. <br />D. The granting of thi� variance will not ad•��rsely affeci; <br />the coinprehensive plan. <br />VI. POSSIBLP STTPi;LATIONS: <br />A. That the easement be permanent and irrevocable. <br />B. That the c�sement be permanently, effectively and privately <br />maintained. <br />C. That address identification for l:he most westerly property <br />be prominently despl.ayed at tlic entrance from 49th St. <br />
