7. The request for the exception was advertised according to the laws of the State <br />of Washington and the City of Everett. No opposition was voiced at the public <br />hearing, and no letters or comments were submitted. There has been no <br />evidence that the proposed garage would have any significant impact on the <br />surrounding neighborhoods. There would be no obstruction of views of <br />neighboring properties, the pitch would be similar to the dwelling on-s!te, and the <br />siding and roof materials would be compatible. (exhibit 1, staff report) <br />8. The Applicant submitted site plans and elevation plans prepared by a ge��eral <br />contractor. The plans depict ihe proposed construction. The City submitted that <br />it had reviewed the plans, and its recommendation was based on the data as <br />submitted on the plans. (Russell/Anderson teslimony; Ingalsbe testimony) <br />CONCLUSIONS OF LAW <br />Jurisdiction <br />Jurisdiction: The Hearing txaminer of the City of Evereft has jurisdicfional authority to <br />hold a hearing and to i�;sue the decision. That authority is set forfh in EMC 15.?6.100. <br />Based on fhe above Findings of Fact, the Hearing Examiner enters the following <br />Conclusions: <br />Criteria and Standards for Review <br />EMC 19.7.020.K The Hearing Examiner, using the review process described in EMC, <br />Title 15, Local Project Review Procedures, may allow detached accessory buildings to <br />exceed 15 feet in height, or to exceed 1,000 square feet in area, as provided herein. <br />The Hearing Examiner shall have the authority to deny an application for accessory <br />buildings which exceed 15 feet in height or a total of 1,000 square feet. The basis for <br />denial is incompatibility with the dwelling and/or neighborhood character. To make this <br />determination, the Hearing Examiner may look to such factors that include, but are not <br />limited to, view obstruction, aesthetic impact on surrounding properties and streetscape, <br />incompatibie scale with dwellings on surrounding properties, and impact on <br />neighborhood character. EMC 19.7.020.K allows the Hearing Examiner to issue <br />exceptions pursuant to the provisions of EMC 19.7.020.H. <br />CONCLUSIONS BASED ON FINDINGS <br />The Applicant requested approval of a permit to construct an 864 square foot <br />detached garage that would be constructed to a maximum height of 19.5 feet on <br />property at 1514 - 50ih Sireet SE, Everett, Washington. The Everett Municipal <br />Code (EMC) 19.7.020.H limits the height of detached garages to 15 feet. <br />However, EMC 19.7.020.K allows for exceptions to this height standard if certair <br />conditions e�cist.
