This appeal followed. <br />XIII. <br />The neighborhood in the vicinity of the mill si.te <br />(except for a non-buildable gulch and a large piece of <br />property owned by Associated Sand and Gravel) is iully <br />developed as single family residences. The large parcel <br />owned by Associated may have been rer.ently s�ld and is at <br />least tentatively planned for single family residences also. <br />CONCLUSIONS OL� LAW <br />1. Carl Condit never established a nonconforr.ting use <br />as same is defined by law and the applicable ordinances. <br />2. A rnill is not permitted in an R-1 zone. <br />3. The granting of a conditional use permit gave <br />Condit no rights beyond the period of time set in the <br />permit. <br />4. A nonconforming use cannot be established by years <br />of use in violati.on of a zoning ordinance.
