A hearing was held on the application of Jack Burgess, 805 Hoyt, <br />Everett, Washington, for a variance from Section 19.12.05U E.M.C. <br />(Everett Municipal Code) Yard Requirements, Paragraphs A and Cr <br />for permission to construct a single family residence to within <br />ten (10) feet of the front property line rather than the code <br />requirement of twenty-five (25) feet. <br />Also, to build to within twenty-four (24) feet of the rear property <br />line rather than the code requirement of twenty-five (25) feet. <br />LEGAL DESCRIPTION: <br />Lot 16, Plat of Granada Seaview Estates <br />ADDRESS: <br />5014 23rd Ave. W. <br />ZONING: <br />R-S, Single family Suburban Residential <br />Air. Scottie Turner represented Mr. Burgess and stated the problem <br />with many of the property lines of the lots in the Granada Seaview <br />Estates are figured from private driveways instead of a public <br />dedicated streets. The original plat map shows the property lines <br />to be measured from the center of the road right-of-way. <br />There was no opposition from the audience. <br />After visually viewing the subject property and considering all <br />the facts, it was moved by Mr. Black, seconded by Mr. Kristianseā¢., <br />and unanimously approved to grant the applicant's request for t.,e <br />following reasons: <br />1. The unusual nature of the lot property lines, which <br />are in effect centerlines of the driveways, creates <br />an unusual problem for the property owner. <br />2. The proposed structure will be built above the road <br />level so this will not create problems to adjacent <br />property owners. <br />3. The granting of the variance will not be detrimental <br />to the public welfare or injurious to property i:1 the <br />vicinity. <br />4. There will be no adverse effect on the Comprehensive <br />Land Use Plan. <br />A hearing was held on the application of Granada Inc, P. O. Box <br />2157, Everett, Washington, for a variance from Section 19.12.050 <br />E.M.C. (Everett Municipal. Code) Yard Requirements, Paragraph C, <br />for permission to build to within ten (10) feet of the rear <br />property lire rather than code requirement of twenty-five (25) <br />feet. <br />
