property because 2 wanted to avoid any damage to my trees. This
would include tearing the bark on any trees on my property. 2
was thinking a situation where a logger might take bark off a
tree when breaking the branches or cutting off parts of the
branches that are on my property. David did not really say
anything about my suggestiun, so 2 am assume he did not agree
with it.
You both mentioned prior damage to your property, including the
tvie when the developers of the area 2 lived in, pushed earth,
etc. onto your property, which I believe was then owned by your
Mother and Father.
I am sympathetic to you and your family that those incidants
occurred. But, I know that you agree that they should not lesson
your responsibilities as far as anything on my property.
I told you, Dan, that I recognize your right to log on your own
land.
However, I want to make very clear to both of you and your other
brother, the trees on my property ara very, very important to me
in many ways, including financially.
While it would be my wish that we cooperate and avoid any
problems which might occur during the logging operation and which
might necessitate getting lawyers involved, I must tell both of
you, in no uncertain terms, my views about this.
Under no circumstances, do I want any tree located on my property
to be cut or damaged in sny way. As noted above, I have sprayed
the cuts made by your surveyors. I do not want any more of such
cuts.
David, you mentioned to me, in so many words, that if someone cut
down a tree on someone else's property they can be paid stumpage.
In other words that would be the limit of that person's
liability.
That my be true in a rural and mountainous areas, but certainly
not in residential areas such as where my property is located.
One of my key rEasons for purchasing the property was the trees.
Any loss of a tree or trees would result in damage to my property
far in excess of any "stumpage compensation." It is possible you
may find a lawyer who would give you a different opinion than
mine, but I would challenge that througY. the various levels of
the court system. I hope that I do not have to do that, but I
3lS
