In a show of cooperation, I decided, at that ti.me, not to discuss <br />that incident any more in that conversatioii. I have sprayed thE <br />cuts with some tree repair matarial. <br />I do, and did, think Dan that you cou13 e�cpressed some concern <br />about what had happened and volunteered to contact your surveyors <br />to make certain that it would not occur again. <br />A number of times, you told me that you would be very careful and <br />not cut trees belonging to someone else. <br />On Monday of this week, as 2 stood taking to David, he stated <br />that a very large (and beautifLl) tree would be cut down. It is <br />clearly on my property, at the southeast corner. It is the one <br />with the rectangle board nailed to it. <br />Although I was shocked, 2 did not express my full concerns. When <br />I told David that it was on my property, he told me that it would <br />be (that is in the future) standing alone. He did not <br />specifically recognize my right not to have the tree damaged, <br />although he did say that he would mention it to your other <br />brother who he said is "the logger." <br />I wili be placiny signs of that and possibly some other trees. <br />That does mean that those are the only trees I have rights in. I <br />do not intend to mark all of trees I have right� in. Latter in <br />this letter, I discuss a survey that I will be making and that <br />may require the posting of additional trees. <br />It seems that it would be prudent for you to not begin your <br />logging operation until I have had the survey and posted any <br />trees that I might choose. <br />David also said that he had at times clean brush, etc. from a <br />nearby park and dumped it �n my property. This, I am reasonably <br />certain, was done before I purchased it this year. He did not s¢�y <br />one way or the other whether he had obtained permission from the <br />owner of the property at that time. He did not say the 3ebris <br />would break down and turn into mulch. I got the impzession that <br />he did not ask permission, but again, I am not certain. <br />David and I walked down the dirt road in the gully and he told me <br />that large machinery would be on the road during the loqging. I <br />told him that 2 recognized that an owner on a property has a <br />right to cut the branches, which overhang his/her property from a <br />tree on someone's property. I told him that 7 would be willing to <br />cut any such branches overhang your property from trees on my <br />Z�5 <br />
