7. Does the proposed development result in a mix of permitted residential and <br />commercial uses allowed by the zoning in which the property is located which <br />would not result from compliance with the development standards and/or <br />design guidelines proposed to be modified. <br />Finding: The proposal is for residential uses only. <br />Conclusion: N/A <br />8. Does the proposed design mitigate the impacts that could be caused by <br />relaxation of the standards which are proposed to be modified. <br />Finding: The proposed design will create more useable open space on site. <br />Required landscaping will be incorporated into the courtyard areas to provide a <br />screened passive open space area. <br />Conclusion: The courtyards provided on site should enhance the sites <br />development, while preserving existing mature vegetation on site. The total amount <br />of courtyard area provided on site will exceed the minimum amount required by <br />code. <br />DECISION: The proposal is approved as submitted subject to compliance with all city, <br />state and federal regulations. The following conditions shall apply: <br />1. Necessary building permits are to be obtained by the applicant from the City of <br />Everett's Building Department. <br />2. The vegetation surrounding the existing courtyard in the southeast corner of the site <br />should be maintained to provide privacy on site. A minimum of Type I quality <br />landscaping should be maintained along the south property line, bounding the <br />courtyard. <br />3. The proposed courtyard on the southwest side of the site should be landscaped with <br />a minimum of Type I landscaping along the south property line, bounding the <br />courtyard. <br />4. Both courtyards must be improved with a bench or other suitable seating area as <br />approved by planning staff. <br />A minimum of 20' of Type III landscaping is required on the property's frontage long <br />Wetmore Avenue. A minimum of T of Type III landscaping is required along the <br />northern interior property line. A minimum of 10' of Type III landscaping should be <br />provided along the property's frontage along 38'h Street, except for the area <br />bounding the courtyard, as described above, which shall be planted to Type I <br />standards. <br />6. A landscape plan and development plan for the open space areas shall be provided <br />at time of building permit submittal. <br />If a complete application has not been filed for a building permit or equivalent <br />construction permit within eighteen (18) months from the approval date of this <br />decision, the permit shall be deemed terminated, unless an exte:tsion is granted. <br />If the permittee requests an extension in writing not later than eighteen (18) <br />months from the land use permit date, the Director may grant a six (6) month <br />
