Risk of Loss. Bank Sponsor shall bear the risk of loss of thc Project Mitigation Credits prior to Closing. 2.5. Represenlalions and Warranties Iianl< Sponsor represents and warrants to Buyer thaC 2.5.1. Bank Sponsor is authorized by the Permitting Authorities to operate the SBMB and to obtain, hold, sell, and transfer Mitigation Credits; and 2.5.2. Bank Sponsor owns the Projcct Mitigation Credits and has the ri�t to scll said credits to Buyer. 2.6. Notice 2.6.1.
