� S` " �'` <br /> . :--. <br /> :i <br /> NOTICE OF CITY ACTION <br /> PLANNING DIRECTOR DETERMINATION <br /> II.B./25-94 <br /> Dear Citizen: <br /> TNTRODUCTION: The City of Everett has received an application <br /> from James Benthuysen for a Planning Director�s Determination on <br /> the proposed addition to a single family residence at 5117 23rd <br /> Avenue West. The applicant has requested continued use of the 25 <br /> foot buffer as deck and yard area to allow for reasonable use of <br /> the property. <br /> Over half of the eastern portion of the property slopes at an <br /> angle of over 25� towards Narbeck Creek ana is therefore <br /> considered an environmentally sensitive area (ESA) by the City of <br /> Everett 2oning Code. Section 37.100 .C.4 requires a 25 foot <br /> buffer beyond the top of bank of this slope. Section 37.050 .D of <br /> the zonina code allows the reduction of building setbacks or <br /> buffers through a Review Process IIB. The Planning Director, <br /> using Review Process IIB. , is authorized to ". . .approve, <br /> disapprove or approve with ,conditions the use proposed by the <br /> applicant" (Subsection 42.100.B) . <br /> If no appeal is filed in response to the Planning Director�s <br /> determination, the decision will be considered final. If an <br /> appeal of the decision is filed, such an appeal must be submitted <br /> to the City�s Hearing Examiner. As a property owner within 300 <br /> ' feet of the subject property, this notice is to inform you that <br /> the Planning Director has issued a determination on the proposed <br /> action as described below. <br /> �CKGROUND: The property is zoned R-S, Suburban Residential. A <br /> addition of approximately 188 square feet is proposed to be <br /> constructed onto an existing single family residence with a <br /> building footprint of approximately 2 ,162 square feet. The <br /> addition will replace an existing deck at the east side of thE� <br /> house. See attached site plan. <br /> �INDINGS AND CONCLUSIONS: Section 37 .050.B states that nothing in <br /> the ESA ordinance is intended to preclude reasonable economic use <br /> of property as set forth herein. If the requirement of this <br /> ordinance as applied to a specific lot would deny all reasonable <br /> economic use of the lot, development will be permitted if the <br /> applicant demonstrates all of the following to the satisfaction <br /> of the Planning Director: <br />
