Lot 9 of the <br /> plat of Granada Sea•�iew Estates No. 2 was created prior to <br /> the ESA Ordinance. <br /> 5. The proposal mitigates the impacts on the environmentally <br /> sensitive areas to the maximum extent possible. Conditions <br /> have been imposed upon the project which will mitigate any <br /> potential environmental impacts. Mitigation requirements <br /> include placing permanent fencing along the top of bank and <br /> recording a native growth protection easement covenant to <br /> protect the site'S environmentally sensitive slope area. <br /> w <br /> DECISION: The City of Everett Planning Director hereby gFants <br /> approval of the request by the applicant to extend the house <br /> within 12.5 feet from the top of bank and to continue using the <br /> remaining buffer area as yard area with the following conditions. <br /> 1. Solid <br /> board, post and rail, chain link, picket fence or other type <br /> of fence that is acceptable to the Planning Department shall <br /> be used. Post an environmentally sensitive area sign on the <br /> , fsnce. <br /> � 2. Provide a recorded covenant protecting the slope. <br /> 3 . Comply with the, recommendations of the January 27, 1994 <br /> Dennis Bruce, P.E. geotechnical report. <br /> AppEALS: The applicant or an owner of property located within <br /> 30o feet of the subject property may appeal this Planning <br /> Director's determination. Any such appeal must be filed within <br /> ten (10) calendar days of the date sgecified below. Appeal forms <br /> are available from the Planning Department and must be submitted <br /> along with the required fil?ng fee.
