As was explained to you in s letter by Dennis Derickson, the <br /> City's Plnnning Director, a school ectivity is en expansion of your current use and <br /> is aubject to the City reguletions which require you to obtain a Special Property <br /> Use Permit. I will essume thnt you received a copy of the City Code seetion which <br /> applles to your proposed use. <br /> One of the purposes oY requirtng your proposed school to obtain a Special Property <br /> Uae Permit is to insure that the facllity meets fire and safety codes and is <br /> compatlble with the surrounding residential neighborhood. Compllance with these <br /> rec�uirements is not only to the City's benefit, but also to the benefit of the ehureh <br /> and the ch{ldren wFo attend your school. <br /> Even though you may view the sehool activity as an extension oi your regular <br /> church curriculwn, the City nevertheless has tl�e responsibility to insist that you <br /> obtain a Speciel Property Use ,Permit. Unfortunately, the City does not have the <br /> latitude to make a special exception in the case of your propaaed school. <br /> I have been informed that you intend to open the school and begin classes this <br /> week. Whtle the City cannot condone the opening of the sch�ol without the proper <br /> permit, it is willing to consider giving ycu special r.onsideration in keeping the <br /> school open during the pendency of the speciel property use permit proceedings if <br /> you would reciprocate by immediately contacting the City to make arrangements <br /> to acquire the necessary permii. 1 would esk that you contact Gerry Ervine at <br /> 259-8731. However, if Mr. Ervine has not been contacted by Monday, <br /> September 14, 1981, this office will heve no al:arnative but to consider what legal <br /> recourae would be required to insure that the City Code is complled with. <br /> I urge you to contact the City as soon es possible to avoid plecing your school in <br /> jeopardy of being closed down.
