9114c <br />Page 2 <br />The present fueling operations do not comply in a number of different areas. <br />Violations include, but may not be limited to, the following: <br />1. <br />2. <br />3. <br />4. <br />5. <br />6. <br />7. <br />8. <br />Failure to obtain permits for the removal of the old underground <br />storage tanks. <br />Failure to obtain permits for the installation of the existing tanks <br />and related dispensing equipment. <br />Section 79.902(e) prohibits the dispensing of Class I or Class II <br />liquids in the fuel tank of a motor vehicle from an aboveground tank <br />(this may be the most difficult problem to solve). <br />Failure to provide protection from vehicular damage <br />,�ec. 79.903 (c) 3). <br />i"ailure to provide a clearly labeled pump master switch <br />(Sec. 79.903 (e) 1). <br />Failure to provide an eme:gency pump shutoff (Sec. 79.903 (e) 2). <br />Fire extinguisher is placed too close to tank. <br />Improper separation of the LPG (propane) tank from the `lammable <br />liquid tanks. <br />As a note of information only, you should be aware that the installation of <br />fuel storage tanks also requires a SEPA review and compliance with the <br />Shoreline Management Pegulations, both of which are administered by the City <br />of Everett P:anning flepartment. <br />We would suggest that you contact the Fire Frevention Bureau to discuss the <br />problems outlined above.
