BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER VARIANCE NO. 32-88 <br />Based upon the written request for a variance from the City's <br />zoning code by: <br />Board of Realtors <br />{� 3201 Wetmore <br />I Everett, WA 98 <br />hereinafter referred o as "_ApptTc­ant," for a variance from <br />E.M.C. 19.40.020, Parking to allow an exemption from the 19 <br />off-street parking spaces required by code for a change of use of <br />two residential structures, one at 1701 32nd St. to be used for <br />office space and two dwelliing units and one at 3201 Wetmore to be <br />used as office space. <br />on the following described property: <br />Lots 1 and 2, Block 766, Plat of Everett <br />Board of Adjustment, following a public hearing on said <br />ication held on October 10, 1988, and further having reviewed <br />testimony, makes the following Findings, Conclusions and <br />r: <br />there have been exceptional or extraordinary circumstances <br />conditions applying to the subject property or as to the in- <br />ed use thereof that do not apply generally to other <br />erties in the same vicinity or zone. <br />a. Finding: The property consists of two buildings on a <br />6,000 square foot lot both owned by the Snohomish <br />County-Camano Board of Realtors. Both buildings were con-i <br />structed as single family residences in the early 19001s. <br />1710 32nd Street: This structure was constructed as ai <br />single family residence and there are no building permits <br />in file to indicate when the number of dwelling units was <br />increased. Senator Vognild began using the garage as of <br />fice space when he was a resident in the building in the, <br />early 1980's and has continued to use the apace for his <br />office since he moved out of the residential unit. <br />3201 Wetmore: This structure was constructed as a single, <br />family residence and used as such until purchased by <br />Snohomish County-Camano Board of Realtors in November of <br />1986, after which they began to use it as an office. <br />Snohomish County-Camano Board of Realtors applied for a <br />business license in February 1987 and at that time they, <br />were informed that they would need to obtain a Use Permit <br />since the use was permitted in the zone but the building <br />was constructed as a single family residence. <br />A Use Permit is required by the City when a proposed use <br />is a permitted use in the zone but the building was con- <br />structed for residential purposes. The reason for this; <br />requirement is that the residential uses have a much lower; <br />parking requirement than a commercial use and because all <br />residential structure may not meet Uniform Building Codes <br />(UBC) requirements for commercial structures. The appli- <br />cant for a Use Permit must provide parking to code for the, <br />use proposed and also obtain a Building Permit in order to <br />show that the construction meets the UBC requirement for <br />the particular use. The City was in correspondence with <br />Snohomish County-Camano Board of Realtors from February <br />1987 to August 8, 1988 in an attempt to obtain a complete <br />Use Permit Application. <br />
